Sand Legal: Alleviating Non-Compliance Risks for Global Enterprises

By

With globalization propelling the industry towards growth, and government regulations broadening around the world, spreading across country borders, the issue of compliance risk has become an aggravating concern. It is no longer just a part of the agenda; rather it is now an agenda in its own. The pace and scale of change being faced by the CXOs and board members today has made them more apprehensive than ever that the old, reactive ways of managing compliance may cause them to lag behind the competitors or leave them exposed to greater regulatory or reputational risk than ever. Organizations are facing compliance challenges with respect to their industry footprint, influence of geography on their compliance strategy and the pressure to stay ahead of emerging compliance trends.

Sand Legal, headquartered in Gurgaon, helps businesses counter these challenges by providing end-to-end compliance management services. The company provides compliance services across the globe, offering the services in about 11 countries while operating from India. “Our expertise is a mix of in-house lawyers, legal professionals, external experts and counsels. We provide clients with end-to-end services in compliance management with the help of internal resources and external consultants,” says B. Sai Chandravadhan, Managing Director of Sand Legal. The company proudly boasts of its extensive expertise in about 15 industries ranging from metal, cement, automobiles, tyres, IT&ITES and pharmaceuticals to textiles and more. In addition to catering to multi-billion dollar companies, Sand Legal also offers its services to small and medium sized companies.

Non-compliance Risk Mitigation
Taking long strides for regulatory risk awareness, Sand Legal provides its clients with the latest updates in the legal environment that applies to them and advises them on how to address those changes in the law. The company has a team of lawyers who track changes in law applicable to their clients’ businesses.

Sand Legal implements compliance tools through a technology partner where entire legal expertise comes from Sand Legal. Through the tool, the company also updates its clients on the latest changes in the law and how it effects. “The reason we work with a technology partner is to ensure that the technology partner is efficient enough to implement the software tool which can come up with regular improvements in terms of providing the results that the clients want from us,” shares Chandravadhan. The company’s legal team and its technology partner have a certain interface where the technology team explains to the legal team the specifications for the content that is developed by the legal team.

The legal team develops the content for the customer keeping in mind the influencing factors which pose non-compliance risk. The first factor is the industry in which the client is. Secondly, the geography comes into play followed by the regulatory and general laws prevalent there. Sand Legal then tries to comprehend the problems which clients will face as a result of violation of the laws. Finally, the legal team draws a metric in order for the client to comply with the law. It is done in congruence with the specifications given by the technology team, and thus the legal knowledge gets transferred into a tool which then helps the client in managing compliances.

Contracts and Litigation
When it comes to contract management, Sand Legal manages both the routine based and the strategy based contracts for its clients. It establishes the parameters that are required to be followed by its clients while entering into contracts with their vendors or service providers. Based on that, it advises the client on whether to go ahead with the contract or not. For the strategy based contracts, Sand Legal advises its clients taking the growth prospects and risk exposure into account. The company’s contract management team discusses the factors with the various stakeholders and draws a plan for the clients, helping them understand the strategy before creating the contract. The team conducts a complete audit of all the litigations which clients have to deal with and helps them get out of litigations.

In a time when cost matters, the cost effectiveness of Sand Legal is evident from the fact that its worldwide services cost less than what a lawyer in the US would demand. Its global clients pay about a tenth of what they would spend on a compliance program otherwise.

Being Different
Sand Legal’s geographical reach is far wider than that of its competitors, offering compliance management services in about 11 countries. Secondly, it has compartmentalized its business model by working with technology partners who take the onus of handling technology. In addition, Sand Legal offers a low response time to clients because of its internal and external teams working together.
